FORTHCOMING CHAMBER JUDGMENTS

The European Court of Human Rights will be notifying in writing nine Chamber judgments on Tuesday 22 August 2006.

Beshiri and Others v. Albania (application no. 7352/03)

The applicants, Njazi Beshiri, Liri Kaba, Xhilda Koka and Sair Preza, are Albanian nationals who were born in 1931, 1948, 1954 and 1944 respectively and live in Tirana (Albania) and Varese (Italy) respectively.

This is the first Albanian restitution of property case.

The applicants complain about the failure to enforce a judgment awarding them compensation regarding two plots of land. They rely on Article 6 § 1 (right to a fair hearing within a reasonable time), Article 13 (right to an effective remedy), Article 1 of Protocol No. 1 (protection of property) and Article 14 (prohibition of discrimination) of the European Convention on Human Rights.

Joyce Barrow, was born in 1943 and lives in Wrexham. Sydney George Pearson was born in 1942 and lives in Birmingham. Timothy Walker was born in 1942 and lives in Shipston Stour in Warwickshire. They are all British nationals.

They rely on Article 14 (prohibition of discrimination) in conjunction with Article 1 of Protocol No. 1 (protection of property) to the Convention.

Length-of-proceedings cases

In the following cases the applicants complain of the excessive length of civil proceedings. They rely on Article 6 § 1 (right to a fair hearing within a reasonable time). The applicant in Chyb v. Poland also relies on Article 13 (right to an effective remedy).
